How long does it take to prepare Official Bankruptcy Forms for a typical bankruptcy?
A trained bankruptcy paralegal or attorney takes about 1 1/2 to 2 hours to prepare a typical Chapter 7 or Chapter 13 bankruptcy. Official Bankruptcy Form software automates much of the form-filling process by automatically filling in redundant data and performing all necessary mathematical calculations.
Do I need any particular training or certification to practice bankruptcy law?
You will need to be admitted as a member of the Bar of the United States District Court where you intend to practice. In some districts, this is as simple as registering with the District Court and paying a registration fee. Other courts require attorneys to complete a test regarding basic federal rules and procedure. Some bankruptcy courts also require attorneys to maintain a certain number of Continuing Legal Education (CLE) credits in subjects related to "Bankruptcy Law" every few years, but most will allow you to start practicing without the CLE credits. Will I need to attend lots of court hearings in the bankruptcy court?
No. In most Chapter 7 cases there is no court hearing. You and your clients will normally only need to attend a brief "341a" meeting with a bankruptcy trustee, which normally takes about 3-5 minutes. In a Chapter 13 case, you will need to attend a 341a meeting and may also need to attend a brief confirmation hearing in court to have your client's proposed Chapter 13 repayment plan approved.
Can I hire appearance attorneys to attend 341a meetings and court hearings for me?
Yes. We can provide experienced bankruptcy attorneys that can appear at 341a meetings and court hearings for you. Appearance attorneys are available in all bankruptcy court districts nationwide and charge a flat fee of $75 per appearance. Will you provide continuing support after the training?
